How Can I Collect?
- Bring the matter to the attention of the other party (by telephone call or conversation).
- Summarize the conversation, concerns, and agreements.
- Send a copy of the summary to the other party. Keep a copy for yourself.
- Have a lawyer at our firm write a demand letter stating your concerns and asking for contract compliance within a certain time period.
- If your contract specifies mediation or arbitration call in a mutually acceptable third party to resolve the dispute
- Otherwise, the conversation summary letter and the lawyer's letter will provide a base for further action.
- As a last resort, file a Verified Complaint for Breach of Contract in Court. If a Judgment is rendered in your favor, your attorney will enforce the Judgment through all appropriate collection proceedings against the debtor.
Who pays your attorney’s fees?
- Have client sign a contract outlining all the terms of your agreement
- Include a penalty clause that states that other party is responsible for all attorney’s fees and costs incurred to enforce the terms of the Contract.
