As a potential heir, you must file a case in probate court to distribute the deceased's estate under a will. Probate is a court-supervised process of moving legal title from a person who has actually died to the person named in the will. Probate is essential to protect the deceased's personal assets in order to pass them to the deceased’s beneficiaries. The granting of probate is the first step in the legal process of administering the estate of a deceased person, resolving all claims and distributing the deceased person's property under a will.
If the deceased has no will, probate court will solely determine how personal assets will be distributed based on Illinois intestate laws.
